Terms of Business

SiteSet Recruitment Pty Ltd
Permanent Recruitment Services
Last updated: October 2026

These Terms of Business provide an overview of the commercial terms on which SiteSet Recruitment Pty Ltd (“SiteSet”, “we”, “us” or “our”) provides permanent and direct fixed-term recruitment services.

Our full Client Terms of Business apply to recruitment engagements and are available on request.

Our Recruitment Services

SiteSet provides permanent and direct fixed-term recruitment services, primarily across civil construction, infrastructure and related industries.

Our services may include vacancy briefing, candidate sourcing, screening, interviewing, candidate presentation, interview coordination, reference checking where agreed, offer management and post-placement communication.

SiteSet does not provide labour hire services under these Terms.

Standard Placement Fee

Our standard permanent placement fee is:

15% of the successful candidate's Total Fixed Remuneration + GST

For this purpose, Total Fixed Remuneration generally includes the candidate's annual base salary or annualised wages plus guaranteed cash allowances and guaranteed cash payments forming part of the first year's remuneration.

It excludes superannuation, discretionary bonuses, non-guaranteed overtime, reimbursements and non-cash benefits unless otherwise agreed in writing.

Different fees may apply where expressly agreed in writing before services are provided.

Direct Fixed-Term Placements

For a direct fixed-term employee placement, the fee is calculated at 15% of annualised Total Fixed Remuneration, prorated according to the initial fixed term, plus GST.

Where a fixed-term engagement is extended or converted to permanent employment during the applicable Candidate Introduction Period, an additional fee may apply in accordance with our full Client Terms of Business.

When the Placement Fee Applies

The Placement Fee is earned when a candidate accepts the client's unconditional offer of employment or engagement.

If the candidate subsequently withdraws and does not commence employment, no Placement Fee is payable and any Placement Fee already paid will be credited or refunded, subject to the conditions contained in our full Client Terms of Business.

If the client withdraws an accepted offer before commencement, no cancellation fee applies unless a separate cancellation fee was disclosed and agreed in writing before SiteSet commenced the assignment.

Payment Terms

Invoices are payable within 14 calendar days of the invoice date.

If an undisputed amount remains overdue, SiteSet may provide written notice and suspend new recruitment work where the default is not remedied.

Where an undisputed amount remains unpaid for five business days after written notice that it is overdue, interest may accrue from the original due date at 10% per annum, calculated daily and not compounded, or the maximum rate permitted by law if lower.

Reasonable third-party debt recovery costs actually and properly incurred in recovering an overdue undisputed amount may also be recoverable to the extent permitted by law.

Candidate Introduction Period

SiteSet's Candidate Introduction Period is 12 months from the Introduction Date.

Where a candidate introduced by SiteSet is employed or directly engaged by the client or a related entity during that period, a Placement Fee may be payable whether the candidate is engaged for the original vacancy or another role.

Where a client can establish through dated written records that it was already in an active and current recruitment process with the candidate for the same or substantially similar role before SiteSet's introduction, the Placement Fee will not apply under the prior-contact provisions.

A historical application, database record, social-media connection or previous contact does not, by itself, establish an active current recruitment process.

Candidate Confidentiality

Candidate information supplied by SiteSet is confidential and must only be used for legitimate recruitment, assessment and employment purposes.

SiteSet will not disclose a candidate's identity or candidate details to a client without the candidate's written permission except where disclosure is required by law.

Candidate information must not be passed to an external third party without appropriate authority.

Where an unauthorised third-party disclosure materially results in the candidate being engaged during the Candidate Introduction Period, a Placement Fee may become payable in accordance with our full Client Terms of Business and applicable law.

10-Week Placement Protection

Eligible permanent placements receive a 10-week Placement Protection period commencing on the candidate's first day of employment.

Subject to our full Terms of Business, where during that period:

  • the candidate voluntarily resigns; or

  • the client terminates the candidate because of genuine and documented suitability, performance or conduct concerns,

SiteSet will undertake one replacement search for the original role.

Placement Protection is a service remedy and is not a general refund guarantee.

Eligibility is subject to the conditions and exclusions contained in our full Client Terms of Business.

Replacement Search

An approved replacement search will be conducted for up to 60 days from the date SiteSet confirms the Placement Protection claim has been accepted.

SiteSet will use reasonable recruitment efforts but cannot guarantee that a suitable replacement candidate will be available or will accept an offer.

The client retains the final decision whether to interview or employ a replacement candidate.

If No Replacement Is Found

Where SiteSet completes the 60-day replacement search in good faith but is unable to provide a suitable replacement candidate, SiteSet will issue a credit equal to 50% of the original Placement Fee.

The credit may be applied to one future permanent placement made within six months after the credit is issued.

The credit is not transferable or redeemable for cash and is subject to the complete conditions contained in our Client Terms of Business.

Placement Protection Exclusions

Placement Protection does not generally apply where employment ends because of circumstances unrelated to the recruitment risk the protection is intended to cover.

This includes circumstances such as:

  • redundancy, retrenchment or restructuring;

  • project cancellation or loss of work;

  • client insolvency, financial circumstances or workforce reduction;

  • material adverse changes to duties, remuneration, location, roster, hours, employment status or working conditions;

  • unsafe, unlawful, discriminatory, bullying or harassing conditions materially contributing to the candidate leaving;

  • failure to provide material employment conditions represented during recruitment; or

  • termination for reasons unrelated to the candidate's suitability, performance or conduct.

The complete conditions and exclusions are contained in SiteSet's Client Terms of Business.

Repeated Early Terminations

Where there is a substantiated pattern of repeated early terminations, materially changed roles, unusually high turnover or repeated Placement Protection claims, SiteSet may review the client's arrangements for future recruitment assignments.

Following that review, SiteSet may propose different pricing, Placement Protection or engagement terms for future assignments, or may decline future assignments.

Any such change does not retrospectively alter an existing placement or accepted Placement Protection claim.

Screening and Client Due Diligence

SiteSet exercises reasonable care and skill in providing recruitment services.

Clients remain responsible for determining the checks required for a particular position and satisfying themselves as to matters not expressly agreed to be verified by SiteSet.

Depending on the role, these may include:

  • identity;

  • qualifications;

  • licences and tickets;

  • competencies;

  • right to work;

  • medical or fitness requirements;

  • police or background checks;

  • drug and alcohol requirements; and

  • project-specific requirements.

Where SiteSet expressly agrees in writing to perform a particular check, we will perform that check with reasonable care and skill.

Reference checks report information supplied by referees and do not guarantee future performance.

Client Responsibilities

The client is responsible for the final hiring decision and the employment relationship following commencement.

Clients are responsible for providing accurate and sufficiently complete information regarding vacancies, including duties, location, remuneration, employment status, roster or hours, required licences and qualifications and material workplace conditions.

Clients must promptly advise SiteSet of material changes to a role or proposed employment conditions.

Candidate Fees

SiteSet's recruitment fees are charged to clients, not candidates.

SiteSet does not require candidates to pay prohibited fees, deposits or bonds, purchase services or use nominated suppliers as a condition of SiteSet finding or attempting to find work for them.

Privacy

SiteSet handles candidate information in accordance with applicable privacy requirements, the candidate's permission and our Privacy Policy.

Clients receiving candidate information are also responsible for handling that information lawfully, securely and confidentially.

Liability

Nothing in these Terms excludes, restricts or modifies a statutory right, consumer guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified.

Subject to applicable law and the complete provisions of our Client Terms of Business, SiteSet does not guarantee a candidate's future performance, conduct or continued employment.

Full Client Terms of Business

This webpage is intended to provide clients and prospective clients with a clear overview of SiteSet's principal recruitment terms.

It does not replace SiteSet's full Client Terms of Business.

Before SiteSet provides recruitment services, clients will be provided with the applicable recruitment fee and SiteSet's full Terms of Business.

The full Terms contain additional provisions concerning acceptance, candidate introductions, fixed-term placements, prior contact, confidentiality, payment, Placement Protection, privacy, liability, termination, dispute resolution and regulatory compliance.

Where there is any inconsistency between this website summary and the applicable Client Terms of Business accepted for a recruitment assignment, the accepted Client Terms of Business govern that engagement.

Regulatory Compliance

SiteSet operates as a private employment agent for the permanent recruitment services covered by our Terms and operates in accordance with applicable Queensland private employment agent requirements.

The services described here do not include labour hire.

Governing Law

SiteSet's recruitment engagements are governed by the laws of Queensland, Australia.
